These Terms and Conditions (“Terms”) set out important information about our services. By enrolling your child in any of our Programs or using our website, you agree to be legally bound by these Terms.

1. Definitions

In these Terms:
“We”, “Us”, “Our” means Aarushi Kaundal, trading as Phonicsandfables.com.
“You”, “Your” means the parent or legal guardian purchasing a service from us.
“Program” means any program operated by us, including Phonics CoveFable Club Readers’ Hub, and Mom, Me and More.
“Video Platform” means any third-party video conferencing platform used to deliver Programs (e.g. Zoom).
“Site” means www.phonicsandfables.com.

3. Enrolment, Information, and Contract Formation

3.1 Your enrolment will be accepted only when:
a) we send you a confirmation email with Program access details; and
b) we have received full payment of the applicable fees.
3.2 Once both conditions are met, a legally binding contract is formed between you and us.
3.3 You confirm that all enrolment information provided is accurate and complete and agree to notify us promptly of any changes.
3.4 We may require certain information from you to provide the Services, including your child’s name, age, learning needs, or relevant medical information. We are not responsible for delays or failure to provide Services caused by your failure to provide such information within a reasonable time.

4. Technical Requirements

4.1 Before enrolling, you must ensure your child has access to:
a) a stable internet connection;
b) a working camera and microphone; and
c) access to the required Video Platform.
4.2 We are not responsible for access issues caused by inadequate equipment, connectivity problems, or third-party platform failures.

5. Fees and Payment

5.1 Registration Fee: A one-off registration fee of Rs.500 per child applies to first-time enrolment only and covers all online and in-person Programs, including 1:1 sessions, unless stated otherwise. Returning students do not pay the registration fee.
5.2 Tuition Fees: Tuition fees are as stated at enrolment and must be paid in advance.
5.3 Once payment is made, you enter into a formal agreement with us and agree to these Terms.
5.4 For online enrolments, Program materials (if provided) are shipped only to addresses within India.

6. Cancellations, Refunds, Suspension, and Withdrawal

6.1 No Refund Policy: All fees paid are non-refundable under any circumstances, including cancellation after enrolment, missed classes, late attendance, or early departure. Any refund, if offered, is entirely at our sole discretion.
6.2 Missed lessons cannot be made up or refunded for any reason.
6.3 If you experience a serious and unforeseen change in personal circumstances, you may contact us to discuss the matter. Any accommodation or change is entirely at our discretion and may require reasonable supporting evidence.
6.4 We reserve the right to cancel or reschedule a Program due to teacher unavailability, low enrolment, or operational reasons. Where possible, we will offer an alternative session or provide a full or partial refund for Services not delivered.
6.5 We may temporarily suspend Services for operational, safety, or technical reasons. If Services are suspended for a substantial period, we may adjust fees so that you do not pay for Services during the suspension.
6.6 If we withdraw a Program or cease offering Services, we will provide reasonable advance notice where possible. If no suitable alternative is available, you may be entitled to a refund for Services paid for but not received.

7. Attendance, Supervision, and Parental Responsibility

7.1 It is your responsibility to ensure that your child:
a) attends all scheduled sessions on time; and
b) completes any assigned homework or practice work.
7.2 Failure to attend or complete work does not entitle you to a refund or replacement session.
7.3 You and your child participate in our Programs at your own risk. You are responsible for supervising your child at all times, including during online sessions. Provided we deliver the Services with reasonable skill and care, we shall not be liable for any loss, damage, or injury arising from failure to follow our instructions.

8. Availability, Delays, and Force Majeure

8.1 We do not control third-party Video Platforms and cannot guarantee uninterrupted access.
8.2 We are not liable for failure or delay caused by events beyond our reasonable control, including system failures, internet outages, natural disasters, strikes, or acts of God.
8.3 If Services are delayed or disrupted due to such events, we will contact you and take reasonable steps to minimise the impact, which may include rescheduling sessions. Where Services cannot be rescheduled and are not delivered, a refund may be issued for the undelivered portion only.

9. Use of the Video Platform

You agree not to use the Video Platform to:
a) disrupt sessions or our business;
b) distribute viruses, malware, or harmful software;
c) send spam or unsolicited advertising;
d) impersonate us or engage in phishing;
e) harm minors;
f) promote unlawful activity;
g) gain unauthorised access to systems or data;
h) commit fraud; or
i) violate any applicable law.
We may suspend or terminate access for violations.

10. Program Content, Accuracy, and Variations

10.1 Program content and materials are provided for educational purposes only.
10.2 While we strive for accuracy, we make no guarantees regarding completeness, correctness, or suitability for any particular purpose.
10.3 Descriptions of Programs and Services on the Site are indicative only. The actual delivery may vary slightly due to operational requirements, teacher availability, group dynamics, or improvements. Such variations do not constitute a breach of contract.

11. No Guarantee of Results

11.1 We may provide guidance regarding the progress children may achieve.
11.2 Enrolment in any Program does not guarantee results, academic improvement, or specific learning outcomes.

12. Intellectual Property, Privacy, and Course Materials

12.1 All Program materials, teaching methods, and content are our intellectual property or that of our licensors.
12.2 You are granted a personal, non-transferable, non-exclusive licence to use materials solely for your child’s participation.
12.3 Materials may not be copied, recorded, modified, distributed, or shared.
12.4 Images of children must not be downloaded, shared, printed, or screenshotted without our express written consent.
12.5 To protect privacy and safety, the use of mobile phones, photography, video recording, screenshots, or audio recording is strictly prohibited during all sessions, whether online or in person, except where expressly permitted by us in writing. Unauthorised recording may result in removal from sessions or termination without refund.

13. Confidentiality and Non-Competition

13.1 All teaching methods, lesson structures, strategies, and materials are confidential and proprietary.
13.2 They are provided solely for your child’s private use and must not be shared, replicated, taught, or used for competing educational or commercial purposes.

14. Website Use and Content

14.1 All content on the Site is protected by Indian and international intellectual property laws.
14.2 You may view and print limited content for personal, non-commercial use only.
14.3 Commercial use of Site content requires prior written permission.

15. Website Disclaimer

15.1 Information on this website is provided for general information purposes only.
15.2 We make no warranties regarding completeness, reliability, or suitability of website content.
15.3 Any reliance on website information is at your own risk.
15.4 We are not liable for any loss or damage arising from use of the website.
15.5 Third-party links are provided for convenience only and are not endorsed.
15.6 We do not guarantee uninterrupted website availability.

16. Limitation of Liability

16.1 Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence.
16.2 To the maximum extent permitted by law, we are not liable for indirect or consequential losses, loss of profit, business, opportunity, or educational outcomes.
16.3 Our total liability for any claim shall not exceed the total fees paid by you for the relevant Program.
16.4 Any claim must be brought within one (1) year from the date the cause of action arose.

17. Disclaimer of Warranties

17.1 Our Services, Site, and content are provided on an “as is” and “as available” basis.
17.2 We disclaim all implied warranties, including fitness for a particular purpose and non-infringement, to the maximum extent permitted by law.
17.3 No advice or information provided by us creates any warranty not expressly stated in these Terms.

18. Indemnity

You agree to indemnify, defend, and hold harmless Phonicsandfables.com, Aarushi Kaundal, and our teachers, contractors, and representatives from any claims, losses, damages, liabilities, costs, or expenses arising out of your breach of these Terms, your child’s participation in the Programs, misuse of the Services or Site, or violation of any law or third-party rights. This clause survives termination.

19. Viruses, Security, and Acceptable Use

19.1 We do not guarantee the Site is free from viruses or malware.
19.2 You must not attempt unauthorised access, attacks, or harmful activity.
19.3 Breach may result in suspension, termination, or legal action.

20. Our Right to Make Changes

20.1 We may make minor changes to Programs or Services to improve quality, safety, or responsiveness.
20.2 If we make significant changes to Services or these Terms, we will notify you in advance. If you do not agree, you may discontinue the affected Services and receive a refund for Services paid for but not received.

21. Communications

21.1 We may send important notices by email relating to Programs or these Terms.
21.2 Marketing emails will only be sent with your consent and will include opt-out options.

22. Governing Law and Jurisdiction

These Terms are governed by the laws of India.
The courts of Delhi shall have exclusive jurisdiction.
